General terms and conditions of sale (GTC)
1. Purpose
These General Terms and Conditions of Sale (hereinafter referred to as the “GTC”) govern the sale of artistic works offered on the website df-abstract.com, operated under the name DF-ABSTRACT.
Any order placed on the website implies full and unconditional acceptance of these GTC by the customer.
2. Nature of the Works
The works offered by DF-ABSTRACT are original artistic creations based on a conceptual and abstract approach.
They are offered in limited, numbered editions and produced to order according to the characteristics described on each artwork page (format, medium, version, edition).
The works may present slight variations related to the manufacturing process or the selected medium, without altering the artistic nature of the work.
3. Prices
The prices of the works are indicated in euros (€), all taxes included.
Delivery costs are included in the sale price unless otherwise explicitly stated on the artwork page.
DF-ABSTRACT reserves the right to modify its prices at any time, without retroactive effect on orders already confirmed.
4. Payment Terms
Works offered on the DF-ABSTRACT website may be paid:
- by credit card, via a secure payment solution;
- by Paypal,
- by bank transfer,
- par Google Pay
The bank transfer details are provided to the customer upon order confirmation.
5. Order Confirmation
The order is considered final:
- Immediately after payment validation for credit card or PayPal payments;
- Only upon effective receipt of funds in the DF-ABSTRACT bank account for bank transfers.
DF-ABSTRACT reserves the right to cancel any order for which payment by bank transfer is not received within a reasonable period.
The works remain the property of DF-ABSTRACT until full payment of the price.
6. Production of the Works
DF-ABSTRACT works are produced to order, according to the specifications chosen by the client (format, medium, version, edition).
This made-to-order production excludes mass manufacturing or permanent stock.
7. Production and Shipping Times
Production and shipping times vary depending on the artwork, selected medium, and technical constraints.
As an indication, a period between 10 and 30 business days should be expected from order confirmation.
These timeframes are indicative and may vary depending on technical or logistical constraints.
DF-ABSTRACT undertakes to inform the customer in the event of exceptional delays.
8. Delivery
Delivery is made to the address indicated by the customer at the time of the order.
Shipping costs are determined according to the geographical zone and specified prior to order validation:
- France and Extended Europe: shipping included.
- United States and Canada: flat shipping rate.
- Rest of the world: flat shipping rate.
The artworks are shipped using professional packaging adapted to their nature and format.
The transfer of risk occurs upon physical receipt of the artwork by the purchaser or by a third party designated by the purchaser.
For deliveries outside France, customs duties, import taxes, or administrative fees may be required by the authorities of the destination country. Any such charges remain exclusively the responsibility of the purchaser.
DF-ABSTRACT shall not be held liable for delays attributable to carriers or to customs procedures specific to the destination country.
In the event of damage or loss observed upon delivery, the purchaser is invited to immediately make precise reservations with the carrier and to inform DF-ABSTRACT as soon as possible.
Where applicable, DF-ABSTRACT will proceed with replacement or reimbursement of the artwork in accordance with the applicable legal provisions.
9. Right of Withdrawal
DF-ABSTRACT works are produced to order according to the specifications selected by the customer (format, medium, variation, edition).
Consequently, no cancellation, return, or refund may be accepted after order confirmation.
In accordance with Article L221-28 of the French Consumer Code, the right
of withdrawal does not apply to goods made according to the consumer’s
specifications or clearly personalized.
10. Intellectual Property
The works offered on the DF-ABSTRACT website are protected by copyright law.
The acquisition of a work does not entail any transfer of reproduction, representation, or exploitation rights unless expressly agreed in writing.
The purchase of a work does not grant any right of reproduction, public display, distribution, or commercial exploitation.
Any unauthorized reproduction, distribution, or use is strictly prohibited.
11. Liability
DF-ABSTRACT shall not be held liable for indirect damages resulting from the purchase of a work, including loss of profit or intangible damages.
DF-ABSTRACT shall not be held liable for the installation or use of the works after delivery.
In any event, the liability of DF-ABSTRACT shall be limited to the amount of the order.
12. Personal Data
Personal data collected are necessary for order processing and customer relationship management.
They are processed in accordance with applicable regulations and the Privacy Policy available on the website.
No personal data are transferred or used for unsolicited commercial purposes.
13. Applicable Law and Disputes
These GTC are governed by French law.
In the event of a dispute, an amicable solution shall be sought as a priority.
Failing this, the French courts shall have exclusive jurisdiction.
In accordance with the provisions of the French Consumer Code, the customer may have free recourse to a consumer mediator.
14. Modification of the GTC
DF-ABSTRACT reserves the right to modify these GTC at any time.
The applicable GTC are those in force on the date of the order.
